That is the existing legal default that sends all DACA’s back as well as all of their younger siblings born here, plus more. On the DACA’s there is no question. The case where the parent has legal issues and is not a citizen of the USA has not yet been addressed. Where the parents have no legal issues and are domiciled in the USA the parents and the child fall into the category of being subject to the jurisdiction of the USA and not just being in the jurisdiction of the USA.
